How to make an insurance claim

Service Details

The Isle of Wight Council Insurance service aims to protect the human, physical and reputational assets of the Council. We provide and manage the process for persons who have had an incident and wish to claim compensation from the Council. 
  • If you wish to make a compensation claim against the Council you will need to complete our online Incident questionnaire.
  • The incident questionnaire is available via the green button labelled 'make a compensation claim'
  • You will need to sign into your 'My Account' or create an account to access and complete the online Incident questionnaire.
  • Provide as much detail about the place, time, type of incident and any photos you may have of the incident and the damage caused.

Notes

  • Only complete our Incident questionnaire if you wish to notify the Council of personal injury or damage to property.
  • A claim for compensation can be made in person or through a legal representative.
  • Please be advised that the damaged property must be retained and made available for inspection.
  • Insurance fraud is a criminal offence. Persons who make fraudulent or exaggerated claims are liable to prosecution.

The Authority is under a duty to protect the public funds it administers, and to this end may use the information you have provided on this form for the prevention and detection of fraud. It may also share this information with other bodies responsible for auditing or administering public funds for these purposes.

Data Protection Statement

The details provided by you will be held on a database and used for the purposes of investigating your claim and may be shared with or passed on to other Council departments or outside agencies who may be involved in a potential claim, as well as the Council’s Insurers or legal representatives so that a formal response to your comments can be made. The Isle of Wight Council is the data controller for the purposes of the Data Protection Act 2018. Please note the information collected may be accessed by virtue of the Freedom of Information Act 2000 or by yourself under the Data Protection Act 2018.


 

Your claim will be processed in the following stages:

  1. Upon receipt of the completed incident questionnaire, we (the Council’s Insurance Section) will work together with the appropriate department(s) to complete an investigation of your incident claim.
  2. Please note: the provision of this form does not constitute an admission of liability on behalf of the Isle of Wight Council.
  3. Once the investigation has been completed all relevant documentation will be passed to the Council’s Insurers. They will then correspond with you or your legal representative.
  4. There is no automatic right to compensation and claims are paid on a strict liability basis.
  5. A claim for compensation can be made in person or through a legal representative.
  6. You may be contacted by us to attend a site meeting at the location where the incident occurred.
  7. If we ask you to attend a site meeting at the location where the incident occurred, you are entitled to bring an Independent Person or Legal Advisor with you.
  8. You will need to keep the damaged property and make it available for inspection if required.
